Terms of Service (ToS) and Privacy Policy - Whibot

Welcome and thank you for using Whibot! These Terms of Service (hereafter "ToS") govern your use of the Whibot Discord bot and its associated Dashboard. By adding Whibot to your Discord server or interacting with it, you fully and unconditionally accept these ToS.

1. Description of Service

Whibot is a utility bot for the Discord platform offering various features to help administrators manage their communities. Its features include, but are not limited to:

• Creation and management of support tickets.
• An auto-moderation system (filtering of words, links, files, etc.).
• Integration with third-party services such as Trello.
• Role assignment via reactions (Reaction Roles).

2. Data Collection and Processing (GDPR Compliance)

To function properly, Whibot needs to process and store certain data about you. Transparency and data security are our top priorities.

A. Collected Data

To ensure its modules function correctly, Whibot automatically records:

• Discord Identifiers (IDs): Users, roles, channels, and servers.
• Moderation Logs: The history of infractions (warnings, mutes, bans) generated by the auto-moderation system.
• Support Ticket Content: Messages sent, participant IDs, and timestamps of actions performed within "Ticket" type channels.

B. Data Retention Period (Ticket History)

For security, request tracking, and moderation purposes, all data and transcripts related to support tickets are kept for a strict maximum duration of 30 days. Beyond a 90-day period, in the event of a failure of the automated system, an irreversible global maintenance purge is applied to our servers.

C. Data Usage

The collected data is never sold, shared with third parties for commercial purposes, or used for advertising profiling. It is used exclusively to:

• Allow server administrators to consult their ticket archives.
• Ensure the application of auto-moderation sanctions over time.

3. Your Rights

In accordance with data protection regulations (GDPR), you have the right to access, rectify, and completely delete your data. If you wish for your information (moderation history, IDs linked to tickets) to be purged from our databases before the legal automatic deletion deadline, you can submit a direct request to the Whibot administration.

4. User and Administrator Obligations

• Compliance with Discord ToS: The use of Whibot must strictly comply with Discord's Terms of Service.
• Member Notification: Server administrators using Whibot agree to inform their members about the recording of their data, particularly when opening a ticket.
• Abusive Use: It is strictly forbidden to use Whibot to generate spam, bypass Discord API limitations, or host illegal content via the ticket or Trello request systems.

5. Limitation of Liability

Whibot is provided "as is". Although we make every effort to ensure continuous service (server monitoring, backups), we cannot be held responsible for:

• Data loss due to a technical malfunction.
• Moderation actions (bans, mutes, message deletions) automatically applied by the bot following the configuration defined by a server administrator.
• Service interruptions related to the Discord platform or our hosting provider.

6. Governing Law and Jurisdiction

These terms are governed by and construed in accordance with French law. In the event of a dispute concerning the use of the bot or the management of data that cannot be resolved amicably, the French courts will have exclusive jurisdiction.

7. Changes to the ToS

We reserve the right to modify these ToS at any time to adapt them to technical or legal developments. Users will be informed of any major updates via our support server or the Dashboard.
